Terms and Conditions

The contract is the document or documents that set out these conditions and all other details about your agreement with us.

“We” and “Us” “Owner” and “Our” mean the seller/supplier of the goods

“You” or “Your” or “Hirer” means the hirer of the goods

The “Goods” mean all goods to be hired by us to you

The “Recipient” means the person, firm, company, corporation or public authority to whom the goods are delivered, when it is not you. These conditions exclude any terms and conditions you may have put forward, except where we have agreed to any amendments or other conditions in writing.

 

1. All equipment remains the property of the Owner, Something Borrowed Weddings.

2. During the period the goods are on hire. The Hirer shall be solely responsible for the hired goods and shall be alone responsible for insuring the goods from the time of acceptance of goods until return and acceptance of goods back into the possession of the Owner.

3. £100 refundable deposit will be required to secure the date, this is taken as insurance and will be returned on satisfactory inspection of the hired goods. Any damages to goods the amount will be taken from the £100 deposit any more and we will send you a bill. The £100 is NOT taken of your final balance.

4. Standard laundering and cleaning is included in the price of the hired goods. However if the Owner finds that irreversible and/or damage through mistreatment has been caused to Hired Goods for example rips, cigarette burns, candle wax, excessive food etc then the will be charged at their full replacement value of £10 per cover. Chair Covers are for Indoor use only. This also applies to any other hired goods. Any loss or breakages must be paid for at the full retail price plus p&p.

5. Goods must be available for collection at the delivery address unless otherwise arranged.

6. Prices quoted are for one days hire only apart from day of delivery and collection.Subsequent days will be charged at a daily rate unless a special agreement has beenarranged prior to the event between the Owner and the Hirer.

7. Wet Chair Covers must not be placed in plastic bags as it may be attacked by mildew andwill then be chargeable at the full replacement cost. Please use bags that are supplied by SBW

8. Final payment is required in full 4 weeks prior to the event. Please note if payment is not received within the terms and conditions of payment, we will presume that our services are no longer required and a cancellation fee will be charged which will be the £100 deposit

9. In the event of a cancelled bookings, a cancellation charge will be levied by the Owner of £100 if cancelled within 8 weeks

10. The Owner reserves the right to use any photography of events for promotional purposesunless otherwise advised by the Hirer

11. If our items have been subjected to irreparable damage through being ripped and torn, damaged with candle wax or excessively damaged by other means, then you, the customer, will be liable for the replacement cost of said items. It is the Hirers responsibility NOT the venue to make sure all hired goods are taken care of and that the venue do not intend to change theirchairs at any point prior to the booking

12. It is the hirer’s responsibility to ensure that the hired items are fully covered by either their own insurance or the venues insurance with regard to public liability risks. Something Borrowed Weddings will not be liable with respect to any claims made by any person for the death, personal injury or damage caused by or in conjunction with the hired items from Something Borrowed Weddings including fitting services.

13. Something Borrowed will collect all items used to dress your event the morning after the event and therefore all items must be available for collection. Any discrepancies are notified immediately to you the customer and an invoice reflecting the replacement value of said items will be issued. The replacement cost per chair cover is £10.00 and £2.00 per sash. You the customer, are solely responsible for all items hired from Something Borrowed before, during and after use.

14. Liability

Something Borrowed Weddings shall not be responsible for injury or damage to persons or property howsoever sustained arising from any goods under hire. The hirer will be responsible for ensuring the chair covers and sashes are fitted correctly to prevent any injury. We shall be under no liability in respect of any defect arising from willful damage, abnormal usage conditions, failure to follow our instruction (whether oral or in writing), misuse or alteration or repair of the linen without our approval.

Except in the case of death or personal injury caused by our negligence, we shall not be liable to you by reason of any representation or any implied warranty, condition or other term, or any duty at common law or under these terms and conditions, for any special, indirect or consequential damage.

 

DIY Hire Period

Hire is for a 24 hour period only or as otherwise stated by Something Borrowed Weddings; usually the agreed pickup date. Orders sent by courier usually arrive 2 days before the event and are picked up by courier on the next working day after the event. We do not dispatch covers until the order is paid for in full. (Must be on cleared funds).

It is the hirers responsibility to ensure the used linen is packed up and boxes sealed ready for collection. If a courier has to leave without picking up the consignment due to the linen not ready, boxes not taped up, misplaced etc, The courier will have to be rebooked resulting in a delay in return and laundering. If linen arrives back late due to a wasted pick up for whatever reason, the hirer will forfeit £50 for each aborted pickup from their damage loss deposit PLUS a daily charge of £2.49 per chair cover & organza sash. If the damage/loss deposit does not cover the total cost, we will send you an invoice and require payment within 30 days from the date of the invoice.

All times we state or quote for delivery/collection are approximate. Goods must be available for collection at the delivery address unless otherwise arranged. All deliveries and collections including aborted deliveries and collections will be charged for.

Delivery by courier is by DHL or TNT and delivery & Pick up is anytime between 08:00 & 17:30pm. Pick up of used linen is on the next working day after the event unless otherwise agreed.

Please ensure you obtain a receipt from the courier when linen is picked up.

When the goods on hire are collected by or delivered to the Hirer or his representative, the Hirer shall inspect the goods and sign the collection/delivery note. In the event of shortage or damage the Hirer shall endorse the note accordingly at the time of collection or delivery. If the Hirer fails to perform any of his obligations under this condition, any goods will be deemed to have been collected/delivered in a satisfactory condition.

The Hirer is responsible for any loss or damage to the goods, from time of delivery until they are collected by the company's employees or until they are delivered back to our premises. Deliveries left at premises are left at the hirer's risk.

We will not be liable for any delays caused by any circumstances beyond our control.

Shortages and damages to hired goods will be charged at their full replacement value, and no substitute item will be accepted by Something Borrowed. The Hirer may request in writing the return (and bear the cost thereof) of any damaged goods within 14 days of the Hirer being informed by phone, Email or writing of any such damage. Otherwise the said items will be disposed of.

Covers may be returned soiled. Any permanent stains or damages to our linen such as mildew damage, food stains (Curry), ink, felt pens , pulls in the fabric and burns etc will attract a replacement charge for each damaged item.

Chair Covers which has been dragged on the floor, used to wipe up spills or placed on earthen ground and are damaged beyond repair will be charged for at full replacement costs.

Sashes must be untied before sending back to Something Borrowed Weddings.

In order to prevent mildew damage, all wet linen must be dried before placing in the boxes. Linen attacked by mildew will attract the full replacement cost listed above.

Loss/damage deposit must be on cleared funds and must be paid before the goods are sent out and will be refunded when all the items hired are returned undamaged.

All orders are delivered with a return address label. It is the hirers responsibility to ensure these labels are affixed securely to the boxes and the boxes sealed securely enough for them to safely travel through the postal system. Boxes not delivered to Something Borrowed, lost in transit or delayed as a result of labels not affixed securely and have fallen off, or boxes not taped up securely are the responsibility of the hirer and the damage loss deposit will be forfeited.

Samples

There will be a charge of £9.99 for chair cover samples sent out in the post. Aaddressed envelope will be sent out with the chair cover so that they can be easily returned. An additional charge of £10.00 will be made for any chair covers NOT RETURNED. You should ensure that you have a 'Certificate of Posting '(which will cover you if the envelope does not reach our offices) from the Post Office when returning the chair cover as we will charge for non return. We advise that you order a sample before placing an order.

Risk to the goods

The risk in the goods will pass to you immediately on delivery of the goods to you or the recipient.
It is your responsibility to ensure that the goods are fully covered by insurance with regard to theft, damage, and public liability risks.

Any failure by us to enforce any or all of these conditions shall not amount to or be interpreted as a waiver of any of our rights
